Employee SMS Privacy Policy

This Employee SMS Privacy Policy explains how R. Yoder Construction ("R. Yoder," "we," "us," or "our") collects, uses, protects, and discloses information associated with the R. Yoder Construction Employee Text Alert Program (the "Program"). The Program is intended for current R. Yoder Construction employees who voluntarily enroll to receive operational workplace text messages.

1. Information we collect

  • The employee's name, mobile telephone number, department, work location, or other employment-related information reasonably necessary to administer the Program.
  • The date, time, source, and method of enrollment, including records showing consent to receive text messages.
  • Text messages, keywords, and replies sent to or received from the Program, including START, STOP, HELP, and related requests.
  • Delivery and technical information, such as message status, timestamps, error codes, carrier information, and whether a message was delivered, delayed, blocked, or unsuccessful.
  • Records necessary to document opt-out, re-enrollment, support requests, security events, and compliance with applicable requirements.

2. How we use SMS information

  • Send weather delays and office or jobsite closure notices.
  • Communicate schedule changes, meeting reminders, and other time-sensitive operational updates.
  • Send workplace safety notices and reminders.
  • Communicate IT outages, system updates, service-restoration notices, and other technology information.
  • Respond to HELP requests and employee questions related to the Program.
  • Maintain enrollment and opt-out records, prevent unwanted messaging, secure the Program, investigate misuse, and comply with applicable laws, carrier rules, and recordkeeping requirements.

3. No sale or marketing disclosure of mobile information

R. Yoder Construction does not sell, rent, or purchase employee mobile telephone information or SMS consent data. Mobile information, text-message originator opt-in data, and consent will not be shared with third parties or affiliates for their marketing or promotional purposes. This restriction applies regardless of any other data-sharing language elsewhere in this Privacy Policy.

R. Yoder Construction may provide limited information to telecommunications carriers, Twilio, hosting providers, information-technology vendors, and other service providers only as reasonably necessary to operate, secure, support, and deliver the Program. Those service providers are not authorized to use Program information for their own marketing or promotional purposes.

4. Other permitted disclosures

R. Yoder Construction may disclose Program information when required by law, subpoena, court order, or governmental request; to investigate fraud, abuse, or security incidents; to protect the rights, safety, security, or property of R. Yoder Construction, its employees, or others; or as otherwise permitted by applicable law. Text-message opt-in data and consent will not be transferred as part of a marketing list or used for third-party lead generation.

5. Twilio and mobile carriers

R. Yoder Construction uses Twilio and participating telecommunications carriers to send and receive Program messages. These providers may process mobile numbers, message content, consent records, delivery information, and related technical data as needed to provide messaging services. Their processing may also be governed by their own privacy and legal obligations.

6. Voluntary participation and alternative communications

Participation in the Program is voluntary and is not a condition of employment, compensation, benefits, or continued employment. Employees who do not participate, or who later opt out, should continue to monitor other official R. Yoder Construction communication channels, including email, Microsoft Teams, supervisor communications, posted notices, and applicable workplace systems. SMS is a supplemental communication method and may not be the only channel used for mandatory workplace information.

7. Message frequency and carrier charges

Message frequency varies based on operational needs, typically 0-10 messages per month; additional messages may be sent during urgent operational events. Message and data rates may apply under the employee's mobile service plan. R. Yoder Construction does not charge a separate fee for the Program.

8. Data retention and security

R. Yoder Construction may retain enrollment, consent, message, delivery, support, and opt-out records for as long as reasonably necessary to administer the Program, document compliance, resolve questions, maintain security, satisfy legal or business recordkeeping requirements, and enforce applicable policies. R. Yoder Construction uses reasonable administrative, technical, and organizational safeguards intended to protect Program information. No text-messaging, telecommunications, internet, or electronic storage system can be guaranteed to be completely secure.

Employees should not send passwords, Social Security numbers, financial account information, medical information, or other highly sensitive information through the Program.

9. Opting out and requesting help

Employees may unsubscribe at any time by replying STOP to a Program message. After the request is processed, the employee may receive one final confirmation message and will receive no further Program messages unless the employee later re-enrolls. Employees may request help by replying HELP. Employees may request re-enrollment by texting START to +1 (574) 633-1736, subject to R. Yoder Construction's enrollment procedures.

10. Changes and contact information

Employee SMS Terms and Conditions

These Employee SMS Terms and Conditions ("SMS Terms") govern participation in the R. Yoder Construction Employee Text Alert Program. By voluntarily enrolling, an employee agrees to these SMS Terms and acknowledges the Employee SMS Privacy Policy above.

1. Program description

The Program sends recurring, non-marketing operational text messages to enrolled R. Yoder Construction employees. Messages may include weather delays, office or jobsite closures, safety notices, meeting reminders, schedule changes, IT outages, service updates, and other time-sensitive workplace announcements. The Program is not intended for advertising, third-party promotions, customer marketing, or subcontractor solicitations.

2. Enrollment and consent

Employees may enroll by texting START to +1 (574) 633-1736 after receiving the Program enrollment notice through a company email, Microsoft Teams announcement, onboarding material, posted notice, or another official R. Yoder Construction communication. By enrolling, the employee expressly consents to receive recurring automated or application-generated text messages from R. Yoder Construction at the mobile number used to enroll. Consent is voluntary, applies only to this Program, and is not a condition of employment, compensation, benefits, or continued employment.

3. Authorized mobile number

By enrolling a mobile number, the employee represents that the employee is the authorized user of that number and that the number is accurate. The employee should promptly opt out or notify R. Yoder Construction if the employee no longer controls the number.

4. Message frequency

Message frequency varies based on operational needs, typically 0-10 messages per month; additional messages may be sent during urgent operational events.

5. Message and data rates

Message and data rates may apply according to the employee's mobile service plan. R. Yoder Construction does not charge a separate fee to participate, but the employee is responsible for any charges imposed by the employee's mobile carrier.

6. Opt-out instructions

An employee may cancel participation at any time by replying STOP. After an opt-out request is processed, the employee may receive one final confirmation message. No additional Program messages will be sent unless the employee subsequently re-enrolls by texting START.

8. Delivery limitations

Message delivery is subject to carrier availability, network conditions, device settings, service outages, number changes, spam filtering, and other circumstances outside R. Yoder Construction's control. Carriers are not liable for delayed or undelivered messages. R. Yoder Construction does not guarantee that every message will be delivered or delivered within a particular time.

9. Supplemental communication channel

The Program is a supplemental workplace communication channel. Employees remain responsible for monitoring other official R. Yoder Construction communication channels. SMS should not be relied upon as the sole source of mandatory safety, employment, payroll, benefits, policy, or emergency information.

10. No emergency-response service

The Program is not an emergency-response service. For an immediate threat to life or property, call 911 or the appropriate emergency authority.

11. Program modification or termination

R. Yoder Construction may modify, suspend, or discontinue the Program at any time. R. Yoder Construction may remove a mobile number when an employee leaves the company, changes numbers, requests removal, repeatedly fails to receive messages, or when continued participation creates a security, operational, or compliance concern.

12. Privacy

Program information is handled in accordance with the Employee SMS Privacy Policy above. In particular, mobile information, text-message originator opt-in data, and consent will not be shared with third parties or affiliates for their marketing or promotional purposes.

13. Changes to these SMS Terms

R. Yoder Construction may update these SMS Terms from time to time. Updated terms will be posted on this page with a revised "Last updated" date. Employees may opt out at any time by replying STOP.

14. Governing law

These SMS Terms are governed by the laws of the State of Indiana, except where federal law or another applicable law controls.
